Injinoo Community Council By-Laws

An extract of by-laws of the Injinoo Community Council which are relevant to tourists and other travellers will ensure that you are fully aware of your responsibilities while on Injinoo land.

1.03 Council statement on by-laws. In the process of deciding upon these by-laws the Injinoo Aboriginal Council was mindful of the history and customs of the Injinoo community, of the special relationship between the community and the lands that are its traditional home, and of the right of the community to determine its own affairs.

1.04 Commencement of application of by-laws. These by-laws commence to be in force on the date of publication hereof [1992] and, except where otherwise expressly provided, shall apply to and be in force within the whole of the Injinoo area

2.02 Duty to be aware. Every person present on the Injinoo Area has a duty to be informed of these by-laws and it shall be no defence to a charge that the accused had no knowledge of the offence that is the subject of that charge.

2.06 Offences and penalties. (1) A person who in any respect contravenes, attempts to contravene or fails to comply with any provision of these by-laws or any requirement or direction duly given under any provision hereof is guilty of an offence.

(2) In all cases other than those to which clause (3) of this by-law relates, a person guilty of an offence against the provision of these by-laws is liable to a penalty not exceeding $500.00.

(3) Where contravention or failure to comply with these by-laws is of such a nature that it may be committed from day to day, a person so charged and convicted is liable to a penalty not exceeding $500.00 for each and every day during which it is continued as from the date of its occurrence until the date of conviction or the date on which the default ceases - whichever is the earlier.

16.02 Fees. The Council may, by resolution order to­

fix a scale of fees payable in

(a) enter, be on or traverse those parts of the Injinoo Area that are not public places; [roads to Cape York; Somerset/Fly point, not East Coast beaches;and Muttee Head are public roads].

(b) use a camping ground;

(c) conduct tours within the Injinoo Area: or

(d) undertake scientific research.

16.03 Agents. The Council may, by resolution, appoint or enter into an arrangement with a person, resident or non-resident, by which the person agrees to conduct guided tours or to be otherwise engaged or involved with the conduct of non-residents within the Injinoo Area.

16.06 Powers of Community Rangers. (1) Where a Community Ranger finds any person committing or believes, on reasonable grounds, that any person has committed or is in the process of coinmitting an offence against the by-laws of this chapter, the Community Ranger may enter and inspect place, premises, vehicle or vessel in the Injinoo Area for the purpose of detecting any evidence of such an offence,

(2) A Community Ranger may give such reasonable directions to non-residents present in the Injinoo Area that are, in his or her opinion, necessary for the safe and proper use of the Injinoo Area.

(3) A Community Ranger may seize any flora, fauna, relic or other object that he or she reasonably believes is in the possession of a person on the Injinoo Area in contravention of any of the by-laws of this Chapter.

16.09 Permit Required. A person must not­

(a) enter or be in the Injinoo Area except in the accordance with

authority so to do conferred under Part VI of the Act; or

(b) camp on a designated camping ground, without first having obtained a permit from the office of the Council, an Authorised Person, Camping Officer or a Community Ranger to so do. (The receipt/sticker you recieve at the Jardine River ferry will serve as your permit).

16.16 Protection of Area. A non-resident must not, in the Injinoo Area­

(a) injure, remove, pollute, foul, litter, deface or damage anything pertaining thereto;

(b) interfere with any animal or plant, except where expressly authorised so to do by a permit issued pursuant to these by­la-,vs or some other written approval issued by Council after consideration and resolution by the Council;

(c) injure or molest any animal;

(d) use or have in his or her possession -

(i) any firearm. airgun, spring gun, bow, catapult or other weapon from which any shot, bullet, arrow or other missile can be discharged, unless he or she is a resident of the Area and is in pursuit of traditional food;

(ii) any trap or snare net or fishing net;

(iii) any explosive devise of any kind, except with the prior written approval of the Council and in compliance, in every respect, with any restrictions or conditions which the Council may impose;

(e) foul or pollute any watercourse;

(f) release any form of marine or aquatic life including the eggs, hatchlings or fry thereof into any watercourse;

(g) dump or leave any refuse or rubbish of any description whatsoever, except in a receptacle provided for that purpose;

(h) deface, injure or destroy any part of a wall or fence or any part of a building, barrier, railing, seat, signboard, natural feature or other structure;

light or cause to be lit any fire, except within a constructed fireplace or a cleared space with a radius of at least 2 metres;

(j) throw any stone or discharge a missile of any kind; or

(k) obstruct, assault, threaten, abuse, insult or intimidate any officer of the Council, Authorised Person or Community Ranger in the exercise of his or her powers or in the discharge of his or her duties under the by-laws of this Chapter.

16.17 Protection of flora, fauna and marine life. A person who is not a resident must not injure, destroy, remove or otherwise interfere with any living flora, fauna or marine life on the Injinoo Area without having first obtained the approval of the Council. (Catching a fish for the camp fire is permitted).
